These Terms of Service (“Terms”) govern your access to and use of Port Aransas Pulse (“Pulse,” “we,” “us”), available at portaransaspulse.com. By using the site you agree to these Terms. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 13 years old to use the site, subscribe to the newsletter, or submit a tip, story, event, or correction. If you are under 18, please get a parent or guardian’s permission first. We do not knowingly collect personal information from anyone under 13.

2. The content we publish

Articles, reports, photos, and other content we publish are for general information only. Fishing reports, surf conditions, tide charts, weather summaries, and event listings are provided as-is and may contain inaccuracies. Always confirm critical details (tide times, weather warnings, event schedules, business hours) with the source before relying on them. Do not use this site as a substitute for professional advice.

3. Your submissions

When you submit a tip, story, photo, event, or correction, you confirm:

  • You own the rights to what you submit, or you have permission from the rights holder.
  • Your submission does not infringe anyone’s copyright, trademark, privacy, or other rights, and is not defamatory or unlawful.
  • You grant Pulse a non-exclusive, worldwide, royalty-free license to edit, publish, distribute, and archive your submission in connection with the site, the newsletter, and our social channels. You keep your underlying ownership.
  • We may decline, edit, or remove submissions for any reason, including length, clarity, accuracy, or fit.

4. Acceptable use

You agree not to:

  • Scrape, mass-download, or republish the site without permission.
  • Attempt to break, probe, or overload the site.
  • Submit unlawful, harassing, defamatory, threatening, or sexually-explicit material, or content that targets a person based on a protected characteristic.
  • Impersonate another person or misrepresent your affiliation with anyone.
  • Use the site to send spam, malware, or unsolicited commercial messages.

We may suspend access, remove content, or report activity to authorities for violations of these Terms or applicable law.

5. Third-party links and businesses

The site links to and lists local businesses, events, and external sites. A listing is not an endorsement. We are not responsible for the content, practices, accuracy, or availability of third-party sites or services.

6. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PORT ARANSAS PULSE AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SITE IS LIMITED TO USD $100.

8. Copyright complaints (DMCA)

If you believe content on the site infringes your copyright, send a notice to dmca@portaransaspulse.com with: (a) identification of the work; (b) the URL of the allegedly infringing material; (c) your contact information; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that you are authorized to act; and (f) your physical or electronic signature.

9. Changes

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.

10. Governing law & venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Nueces County, Texas, and you consent to personal jurisdiction there.
